Hotel Montefiore Terms and Conditions
1. These regulations shall specify the privacy policy and terms of use of the home site of Hotel Montefiore, whose address is www.hotelmontefiore.co.il (hereinafter: the “Site” and/or “Hotel Montefiore”) of the R.T.M. Corporation Ltd., H.P. 511998452 (hereinafter: “R2M.” or the “Company”)
2. The purpose of this privacy policy is to clarify and explain the privacy policy regarding the use of the site and the uses of information provided to Hotel Montefiore by users of the site or collected by Hotel Montefiore as part of the use of the site.
3. The policy does not apply to information that was explicitly excluded from the application of the policy, including within the framework of the terms of use regulations on the site, unless explicitly stated otherwise.
4. Please read this Privacy Policy Addendum and the Terms of Use (hereinafter – the “Terms of Use”) before using the Website and before transferring personal data (such as name, email address, etc.) to Hotel Montefiore through the Website. This document forms part of the site’s regulations and these documents must be read together.
5. Use of the Website is conditional on your consent to this Policy and the Terms of Use. By using and viewing the Website and/or transferring details within its framework, the User confirms that he has read these Terms and agrees to what is stated in them.
6. Hotel Montefiore may, at its sole discretion, change from time to time the provisions of this document and/or the regulations and/or any other document that will replace them or in addition to them to regulate the terms of use of the site. Users are requested to refer to this page from time to time in order to read its updated terms.
7. The contents of this document are written in the masculine gender for convenience only, and everything stated therein is intended for both men and women. Likewise, everything stated in the singular should be read as if it were also said in the plural, as the case may be, and vice versa.
8. The headings in this document are not binding or exhaustive and are intended for the convenience of users only.
9. Everywhere in this document where it is written “we” or “our”, etc., as well as “Hotel Montefiore” or “the Site”, the reference is to RTU and anyone acting on its behalf (including the operators and managers of the site).
Billing at delivery time
10. Hotel Montefiore explicitly clarifies that the charge for an actual order will be made according to the availability of the products close to the delivery of the order to the customer
Information Collection
11. Hotel Montefiore may collect and maintain any information about the surfers and users of the Site transmitted by them or collected by them as a result of and/or in connection with their use of the Site. This information consists of two types:
11.1 “Active Information” – information (such as: name, address, credit card number, ID number, email, telephone, etc.) provided by the user for various purposes (such as purchasing through the site, signing up for a newsletter, registering to view content and/or service provided on the site that requires specific registration (if any), contacting a customer service center, etc.). In this regard, we note that during the viewing and use of the site there are various content and/or services whose viewing and/or use sometimes require a registration process, in which the user may be required to provide personal details (unless Montefiore decides otherwise at some time). It is clarified that the Users are not obligated (by law or otherwise) to provide these details or any other details to the Company, but failure to provide them may limit the viewing and/or use of the Website and/or part thereof
11.2 “Passive information” – information collected without being actively provided by users (such as: type of browser used by the surfer on the site, surfer’s IP address, sites and content preferred by the surfer, etc.). In this regard, it is clarified that the Website may include and/or make use of various identification and/or tracking technologies such as cookies. These software and applications enable the collection of information about surfers (such as information regarding their personal preferences), inter alia for the proper operation of the site, adapting the site to the user’s personal preferences, improving service to users, improving the company’s products, verifying details transmitted through the site, information security, etc. Sometimes the operation of these programs and applications is conditional on the user’s approval, but it is clarified that in not all cases such approval is requested. It should be noted that sometimes it is possible to block the use of the aforementioned programs (or delete them from the hard disk of the user’s computer, if saved there) through the Internet browser, but the Company is not responsible and/or controls the aforesaid and a user who wishes to do so should check this option according to the browser he uses. In any event, it should be remembered that deleting cookies or stopping their receipt may prevent or limit access to the Website and/or parts thereof.
12. Hotel Montefiore may collect and retain any such information (both active and passive) in any manner and manner and for any period it chooses, at its sole discretion. It is clarified that Hotel Montefiore may collect both personal information of users and information that is not identified, inter alia for the purpose of improving the Site, the Company’s products, the services provided by it, etc. In addition, it is clarified that Hotel Montefiore may include the information collected as aforesaid in the database in its possession.
13. It should be emphasized that the provision of information depends on your consent and desire and you are under no obligation (legal or otherwise) to provide information on your behalf and you may not fill in the fields designated for such information and/or part of it (however, as stated, there are details whose provision is a condition for viewing and preserving the content of the site).
Cancellation / Modification of Order
14. Cancellation of an order and / or a change in the reservation by telephone and / or email is possible only with the customer service center of Hotel Montefiore. The sole consideration for not charging or charging money in light of cancellation and/or change lies with Hotel Montefiore’s customer service center.
Send updates and promotional information
15. By entering information into the Site by the User as part of the registration process for the Hotel Montefiore customer newsletter and/or as part of a purchase through the Website and/or entering any information and/or any other material through the Website, the User authorizes Hotel Montefiore to use such information and store it in the database managed by Hotel Montefiore (hereinafter: the “Database”) and also confirms that Hotel Montefiore will be entitled to make use of the details provided by him for the purpose of direct mail (including by mail, Telephone, fax, e-mail, short message messages including MMS, SMS, automatic dialing system, etc.) of any information pertaining to Hotel Montefiore, its products, the benefits provided by it (including benefits for the purchase of products of third parties), etc. and any other use permitted by law, all without the use being considered an infringement of the User’s privacy and will not entitle the User to any relief and/or compensation and/or consideration whatsoever.
16. The User may revoke this consent at any time by giving written notice that Montefiore has been imposed by Info@hotelmontefiore.co.il and the Montefiore Hotel shall act in accordance with the User’s notice, within 7 business days from the time such notice was received by him. It is clarified that as long as Hotel Montefiore has not received a request for removal from the database and/or mailing. As stated, Hotel Montefiore does not check the up-to-date and correctness of the details provided by the user and/or the relevance in mailing any advertising material to that user and it will be entitled to use the collected details at its discretion as stated in this document above.
Transfer of information to third parties
17. The information provided to us by the users and/or collected by us within the framework and/or as a result of the use of the site will be kept in accordance with the Protection of Privacy Law, 5741-1981 and its regulations and any law. Such information will be stored in Hotel Montefiore’s databases, at its discretion, and will not be transferred to third parties other than business partners and/or entities that provide services to R.T.O.M. or anyone on its behalf.
18. Notwithstanding the provisions of Section 17 above, Hotel Montefiore may transfer to any third parties information transferred to it by users or collected by it as part of and/or as a result of the use of the Website, including personal information, without obtaining the User’s consent in the following cases: • If Hotel Montefiore believes that the provision of the information is necessary to prevent damage to the User or to third parties. • If the provision of the information is required by virtue of the law and/or a judicial order and/or order of any competent authority. • If a user violates the terms of use of the site or performs actions prohibited by law (including an attempt to perform such actions). • If there is a dispute and/or legal dispute between Hotel Montefiore and/or a user of the Site and for the use of other legal proceedings in which R.T.M. is involved, as necessary and at the discretion of Hotel Montefiore. • If R.To., if it merges with other parties, sells its operations, changes its ownership, transfers its business (in whole or in part) to any third party, etc. – in this case, R.To. may transfer the information it has collected about the users, and any other material in its possession, to that party.
Server
19. The server hosting the Site may be located outside of Israel. In any event, we will collect, process and use information about surfers solely in accordance with the provisions of this Privacy Notice.
View information
20. Every user has the right to contact us for the purpose of reviewing the information pertaining to him and which is in the database of Hotel Montefiore. In addition, the User is entitled to request a change and/or correction of the information about him stored with us and/or its deletion, all in accordance with the provisions of the law. It should be noted that notwithstanding the foregoing, the Company is entitled to keep in its databases information about the User that it collects independently and/or does not use for the purpose of contacting the User (such as information required by the Company or assisting it in its business activities), all in accordance with and subject to the provisions of the law.
Information Security
21. This website implements systems and procedures for securing the information stored in order to reduce unwanted penetration into it. However, it is clarified that the actions we take to secure information do not provide full protection. In light of the foregoing, Hotel Montefiore does not guarantee that the information and everything contained on the Site and the services provided therein are immune from unauthorized access to them and it cannot guarantee that unauthorized third parties will not gain access to the information provided and/or collected with respect to users. Therefore, we recommend that users exercise caution when submitting information via the Internet in general, and before submitting such information to the Site, the benefits and risks involved in transferring such information must be considered.
Third Party Sites
22. The site may contain links to websites operated by third parties that are not under our control or responsibility and the user should note that this privacy policy does not apply to the sites and clarify the policy adopted by them in the matter.
Governing Law and Jurisdiction
23. The law applicable to and in connection with this Privacy Policy and the use of the Website is the Israeli law only (whether the use of the Website is made in Israel or abroad).
24. The exclusive jurisdiction in connection with this Privacy Policy and the Terms of Use of the Website is vested in the competent court in Tel Aviv-Yafo only.
